Assumption of risk
I understand that boating and water activities involve inherent and other risks that may cause property damage, serious injury or death. These include drowning; slips and falls; changing weather, wind, tides and currents; marine life; collisions with vessels, people or objects; equipment use or failure; and other water-related hazards. I knowingly and voluntarily accept these risks in participating in my Coastal Cruisers rental or experience.
Safety and operating rules
I agree to follow all safety instructions, briefings, operating rules and applicable boating laws. I will wear and use a properly fitted life jacket as instructed and ensure that members of my party do the same, including any legally required use. I acknowledge the operating boundaries, return time and weather and safety requirements communicated for my rental. I will obtain clarification before launch if I do not understand them, stay within the permitted boundaries, return on time, and stop or return when instructed or when conditions become unsafe. Signing this waiver does not replace the pre-launch safety briefing.
No impaired operation
Operating the vessel while impaired by alcohol, drugs or any substance that affects safe operation is prohibited. I will not operate while impaired or allow an impaired person to operate the vessel.
Minors and my party
I am at least 18 years old and am the primary renter. I accept responsibility for supervising minors in my party and ensuring my party follows all safety requirements and operating instructions. I understand that this acknowledgment does not purport to release claims belonging to another adult or a minor where Florida law requires separate consent or does not permit such a release.
Equipment and damage
I will use the vessel and equipment responsibly and report damage or safety problems promptly. I accept responsibility for damage caused by my or my party’s misuse, negligence or violation of rental rules, to the extent permitted by law. This does not impose responsibility for ordinary wear and tear or damage not caused by such conduct.
Release and waiver of claims
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I voluntarily release and waive claims against Coastal Cruisers Florida and its owners, employees, agents and affiliates arising from my rental, boating or water activities, including claims arising from their ordinary negligence. This release does not apply to gross negligence, intentional misconduct, or any liability or rights that cannot lawfully be waived. I understand that I am giving up certain legal rights, including the right to bring claims covered by this release.
Emergency assistance
If reasonably necessary, I authorize Coastal Cruisers Florida and its personnel to seek or provide emergency assistance for me. This authorization is not a promise of medical care or rescue and does not require anyone to act beyond their training. Any assistance for a minor remains subject to applicable law and the authority of their parent or legal guardian.
Voluntary electronic signature
I have had an opportunity to read this waiver and ask questions. I understand its terms and sign voluntarily. By typing my full legal name as my digital signature and checking the agreement box, I intend to sign this waiver electronically with the same effect as my handwritten signature. A copy of the accepted waiver, my signature and the signing date and time will be saved with my booking request.
Signing date and time are recorded automatically when you submit, along with your booking number.
